These conditions in this document establish the conditions governing the use of the website, including ordering products, owned by Mominti with with email info@mominti.com. Please read the Conditions carefully before using this website or placing an order. By using this website or placing an order, you agree to be bound by these terms. If you do not agree to all of these terms, do not use this website and do not place an order.
These terms may be modified; it is your responsibility to read them periodically, as the terms in force at the time of use or order will apply to you.
1. SCOPE OF THE CONTRACT
These General Terms and Conditions apply to the sale of all Mominti products through its website to consumers in Europe. Mominti informs that its website is aimed at persons over 18 years of age. By placing an order through this website, you declare that you are over 18 years of age and that you have the legal capacity to enter into binding contracts.
2. YOUR DATA
The personal information you provide to us will be handled according to our Privacy Policy. By placing an order, you understand that we need to process your information and you confirm that all data provided is accurate and truthful. If you do not provide us with all the information we need, we will not be able to process your order. You acknowledge that it is your responsibility to keep your information updated and to ensure that it is correct.
3. USE OF OUR WEBSITE
By using this website and placing orders on it, you agree to use this website only to make legally valid enquiries or orders. Not to make speculative, false or fraudulent orders. To provide us with your true and correct email address, postal address and other contact details.
4. AVAILABILITY OF PRODUCTS
All orders are subject to the products being available. If there are difficulties in supplying products or if items are out of stock, your order will be cancelled and we refund any amount you may have paid.
5. RIGHT TO CANCEL OR NOT TO ACCEPT AN ORDER
We will always try to process all orders but there may be circumstances which require us to cancel an order after we have sent the order confirmation and we reserve the right to do so at any time without being liable to you or any third party.
We may cancel or refuse to accept any confirmed order:
In the event of a technical and/or typing error in the prices or other details of products when the order was placed.
Due to a lack of availability, as described in 4.
When the security systems indicate that the order may be fraudulent.
When there are reasons to indicate that the user is a minor.
We reserve the right to withdraw any product from this website at any time when needed and cancel the order because of this.
If you wish to cancel or change your order after you placed it, please reach out to us by email at info@mominti.com. If the order has not yet shipped, we will try our best to change the order to your request.
8. PRICE AND PAYMENT
The prices on this website are expressed in EUROS and include VAT, but exclude shipping costs, which will be added to the total amount due as set out in the Shipping section.
Delivery of the order may be subject to customs duties. This depends on the country we will be shipping to. Mominti will not be held responsible for additional duties that may occur. We advise you to check with local authorities what you can expect.
Payment methods
You can pay with Visa, MasterCard and PayPal. To minimise the risk, your credit card details will be encrypted. The charge on your card will be made at the time you confirm your order. By confirming the order you are confirming that the credit card is your property. Credit cards will be subject to verification and authorization by the issuing entity. If the entity does not authorize payment, we are not responsible for any delay or lack of delivery and we will not be able to complete the sale.
6. DELIVERY AND DELIVERY COST
The delivery time set on the website is merely indicative. However, Mominti will endeavour to respect this time frame but will not be liable if the initially estimated time frame is exceeded.
Delivery will be made to the address you provide, which may be different from your usual residence, and may be sent to your workplace or even to a third person to whom you wish to give a gift. It could occur that identification of the buyer or the person to whom the product is addressed will be required by means of an official identification document and/or signature of the delivery note. In case you need to make any changes to the address provided, please reach out to the delivery company directly. Mominti will not be held responsible if the order cannot be delivered due to a mistake in the address and is sent back to us. If this occurs, we will arrange a refund once we receive the returned order.
The delivery cost is calculated according to the delivery method chosen and the items purchased. The exact transport cost will appear before the customer confirms the order.
The delivery charges may be altered at any time without prior notice. Said change shall become effective from the moment the modification appears on the website. In all cases, the delivery charges that appear at the moment the order is placed shall apply.
7. IMPOSSIBILITY OF DELIVERY
If after two attempts we are unable to deliver your order, the transport company will store the product for 15 days so that you can collect it. In addition, we will leave you a note explaining where your order is and how to collect it. If you are not going to be at the delivery location at the agreed time, please contact the transport company to arrange delivery on another day. After 15 days, if the order has not been delivered for reasons not attributable to us, we will be authorised to recover the products, without the possibility of claiming them.
8. Exchanges and returns
The customer has the right to withdraw from the purchase and return the product(s) purchased and/or exchange their size, without the need for justification, within 14 calendar days from the receipt date (the date the delivery service has delivered the package). If the products in their confirmed order are delivered separately, on different dates, the receipt date of the last product shall apply for the purposes of the return.
Please email us at info@mominti.com to register your return or exchange. If you return a defect product, please let us know what kind of defect you noticed.
As we are a small business, we kindly ask you to cover the return shipping costs yourself.
For a full refund or exchange, it is important to meet the following conditions:
You have requested and submitted an online return (stating your original order number) within 14 days of the delivery date, and then returned the item to us within 14 days of submitting the return. Items not returned within this period will not be accepted.
The item is in its original condition, with all hang tags, stickers and clear packaging still present and attached.
The item is clean (without stains such as white deodorant stains, make-up stains or strong odor), unused, undamaged, unaltered and unwashed.
Please include a note in the package with your name and order number, so we know the package is from you.
If the item does not arrive in the above condition, we unfortunately cannot process a return. We will inform you through email if this is the case. If you wish to receive the item back, you will have to pay the shipping costs again yourself.
Processing your return
Once your return has been delivered to us and meets the above mentioned conditions, you will usually be refunded within 7 business days. You will receive an email notification once your order has been refunded. A credit will automatically be applied to the original payment method. Extras, such as express shipping, are not refunded.
Not seeing your refund?
You should receive your refund within a few business days of receiving the refund notification. If you do not see the money in your account, please contact your bank before contacting us.
9. RESPONSIBILITY
At Mominti, we do our best to ensure that product descriptions and specifications are as accurate as possible. The colors shown on the website are meant to represent the actual product colors, but they might vary slightly due to your screen and browser settings.
We are not responsible for any damages caused by events beyond our control, such as natural disasters, strikes, wars, technical failures, maintenance work, interruptions, access problems, website availability, data loss, or delivery delays. If such events occur, our obligations will be temporarily suspended and will resume as soon as possible after the event. We will then find a solution to complete your order.
If Mominti is found to be liable, this liability will be limited to the amount paid by the user.
10. INTELLECTUAL PROPERTY
Mominti is the owner of all intellectual and industrial property rights appearing on the website as well as the elements contained therein, in particular, images, video, texts, brands or logos, colour combinations, structure and design. All rights to this effect are reserved.
Pursuant to the provisions of Royal Decree 1/1996 approving the revised text of the Intellectual Property Law in article 17, the reproduction, distribution and public communication, including the method of making available, of all or part of the contents of this website, for commercial purposes, on any medium and by any technical means without the express authorisation of Mominti Mominti® and its logo are registered trademarks.
11. VIRUSES, PIRACY AND OTHER COMPUTER ATTACKS
We will not be liable for any loss or damage resulting from a distributed denial-of-service attack, viruses or other technologically harmful or damaging material that may infect your computer equipment, data or other proprietary material due to your use of this website or to your downloading of any content posted on it, or on any website linked to it.
12. LINKS FROM OUR WEBSITE
Where our website contains links to other websites and materials from third parties, these links are provided for information purposes only, and we have no control over the content of such websites or materials. We therefore accept no liability for any damage or loss arising from their use.
13. WARRANTY
Any anomaly at the time of delivery must be reported immediately through email at info@mominti.com. If you receive a damaged package, this must be noted on the delivery note of the transport company, otherwise, no responsibility will be accepted and you must contact the transport company.
Als er sprake is van een productiefout, dan kan het product retour gestuurd worden conform artikel 8 van deze algemene voorwaarden. Productiefouten die ontdekt worden nadat de retourtermijn is verlopen, kunnen worden doorgegeven aan de klantenservice. De consument kan dan alsnog het product retouren binnen de wettelijke garantietermijn die binnen het land waar de consument gevestigd is, geldt. Als na beoordeling is gebleken dat er daadwerkelijk sprake is van een productiefout, ontvangt de consument een nieuw product of geld terug. The replacement material will be the same or a similar product if the original is out of stock.
Breakages, tears or chips due to misuse are not covered, nor is the wear and tear of materials due to use.
14. VALIDITY OF OFFERS
The offers offered on are valid while stocks last. If the stock is exhausted, the amount paid by the customer will be refunded or a product with the same or superior characteristics will be offered.
15. APPLICABLE LAW AND JURISDICTION
The T&CG shall be governed by Spanish common law or, where applicable, by the local law applicable to each Participant in the Territory.
For the resolution of any discrepancies that may arise from the interpretation and/or execution of the T&CG, and unless required by applicable local legislation, Mominti and the Participant submit, expressly waiving any other jurisdiction that may apply to them, to the jurisdiction of the courts of Barcelona (Spain).
